In
an early demonstration of the commitment to protect employee
rights aggressively, yesterday President Obama signed the Lilly
Ledbetter Fair Pay Act of 2009. The Ledbetter Act permits claims
to be brought based upon allegedly discriminatory compensation
decisions or acts taken in the past, however distant, that have
an impact upon
compensation paid within the statute of limitations for filing claims
under certain federal laws prohibiting discrimination on the basis
of sex, race, age and disability and other unlawful grounds.
It
amends Title VII of the Civil Rights Act of 1964 and the Age
Discrimination in Employment Act of 1967 and modifies the operation
of the Americans with Disabilities Act of 1990 and the Rehabilitation
Act of 1973. The Ledbetter Act was passed to overturn the U.S.
Supreme Court’s
5-4 decision in Ledbetter v. Goodyear Tire & Rubber Co.
