New Philadelphia Ordinance
Provides for Unpaid Leave for Victims
of Sexual and Domestic Violence


A new Philadelphia Ordinance entitled “Entitlement to Leave Due to Domestic or Sexual Violence” took effect on January 5, 2009, amending the Philadelphia Fair Practices Ordinance.

The new law requires employers in the city to give unpaid leave to employees who are victims of domestic abuse, sexual assault, or stalking, or their qualifying family or household members.

Employers with fewer than fifty employees must provide up to four (4) weeks of unpaid leave annually to eligible employees, while employers with fifty or more employees must provide up to eight (8) weeks of unpaid leave to eligible employees in a 12-month period.
